Dear Chairman Nava and Committee Members:

We are writing as members and supporters of Environmental Entrepreneurs (E2), to express our support for SB 974 by Senator Lowenthal. E2 is a national organization of business leaders who support environmental policies based on their economic merits. Nearly 600 of our members reside in California.

As business leaders, we recognize that good environmental policies encourage innovation, discourage waste and prevent pollution costs from being transferred inadvertently to consumers, other companies or the government. SB 974 would levy a fee of $30 per shipping container processed through the ports of Los Angeles, Long Beach and Oakland to be used for improving goods movement infrastructure and for mitigation of environmental impacts of container traffic. We strongly support SB 974 because it will:

  1. Help California's ports remain competitive. The Ports of Los Angeles and Long Beach are losing their competitive advantage due to the state's overwhelmed goods movement transportation system. The Los Angeles Economic Development Corporation projects that Southern California must spend at least $10.5 billion to improve railroads, rail yards and highways to keep up with surging international trade or risk losing more than 500,000 new jobs and more than $1 billion in tax revenues per year. SB 974 will help ensure that the Ports of Los Angeles and Long Beach - as well as the Port of Oakland - remain competitive by funding essential infrastructure upgrades and pollution control projects.

  2. Place the fair share of the costs of pollution on the source. The Ports of Los Angeles, Long Beach and Oakland are the first, second and fourth largest container shipping ports in the nation, respectively, and move approximately 60 percent of the cargo distributed throughout the United States. With this large percentage of the national cargo transport comes staggering pollution. As a result, California residents bear the brunt of the costs and health impacts associated with shipping goods well beyond the state's borders, while those outside California benefit from cheaper goods from overseas. This bill would ensure that a share of the costs of shipping cargo through California's three main ports is borne by those benefiting from the expeditious shipment of those goods.

  3. Save California billions of dollars in health care costs. SB 974 will generate funds for air quality projects to save both lives and significant health care costs. The California Air Resources Board (CARB) recently estimated that port and goods movement-related air pollution causes 2,400 premature deaths each year, and that reducing statewide goods movement emissions would save lives and achieve a public health benefit valued at $200 billion by 2020. Moreover, CARB estimates that for every dollar invested in reducing harmful pollution, the state will realize up to $8 in benefits from health impacts avoided.

  4. Contribute to California's efforts to combat global warming. Last year the Legislature passed, and the Governor signed, AB 32, a landmark bill that limits California's global warming emissions. The state's ports and goods movement system - replete with diesel-burning ships, trucks, trains and yard equipment - spews forth a consistent stream of sulfur oxides (SOx), nitrogen oxides (NOx) and diesel particulate matter ("diesel soot") - emissions which contribute significantly to global warming. In fact, by 2020, the goods movement system will be the largest source of diesel emissions in the entire state - producing more diesel soot than all passenger vehicles, off-road equipment and stationary sources combined. Fee revenue from SB 974 would be used to fund sorely needed engine replacements and retrofits as well as port electrification and alternative, "green" transport systems which will reduce energy consumption, thereby reducing greenhouse gas emissions.
SB 974 will create an economically feasible mechanism to address port pollution and help California achieve its global warming goals while also protecting the environment and public health. Please vote "aye" on SB 974 and help ensure its passage out of your committee. Thank you for your consideration.
