RE:  Council on Environmental Quality (CEQ) Proposed rule to Update Regulations Implementing the Procedural Provisions of the National Environmental Policy Act. Comments for the Record: Docket CEQ-2019-0003-0001
Dear Chair Neumayr,
As members and supporters of E2 (Environmental Entrepreneurs), we write to oppose recent proposed rule making significant changes to the National Environmental Policy Act (NEPA).

E2 is a national, nonpartisan group of more than 7,000 business leaders, investors and others who support policy that is good for our economy and good for our environment. E2 members have founded or funded more than 2,500 companies, created more than 600,000 jobs, and manage more than $100 billion in venture and private equity capital.
For more than 50 years, NEPA has been a cornerstone for protecting our nation’s environment – and in turn, our economy. It ensures the government considers the environmental and economic impacts of the major projects that it funds and approves.

NEPA provides a conduit for public and businesses to address concerns about the impact of a government decision on communities, businesses our shared environment. Currently NEPA review includes consideration of climate risks when developing major projects – consideration that is essential to planning for and preventing potential economic disasters tied to rising seas, extreme weather and other climate-related disasters.

Many E2 members have undergone NEPA review and can relate to the urgency of timely approvals.  Our businesses also depend on the government making environmentally and economically sound decisions.

As such, we support constructive efforts to make NEPA implementation more efficient and more effective. Unfortunately, this rule is not such an effort and rather than improving project review, it is likely to result in setbacks for our economy and our environment.

This extreme proposal creates uncertainty, increases financial risk, and undermines the rights and interests of businesses and investors across the country. It also weakens environmental safeguards that we and others rely on. It does so in part because it:
  • Ignores climate risks. That in turn sets our economy and our businesses up for failure. Business are increasingly facing the economic costs of climate change. BlackRock, the world’s biggest asset manager, estimates climate change poses an unprecedented threat to nearly $4 trillion in real estate. The congressionally mandated National Climate Assessment forecasts that climate-related risks will cost our economy $500 billion a year. We need NEPA to ensure that the government does not heedlessly approve projects that make conditions worse.
  • Weakens reviews and limits public input – including input from businesses. That in turn undermines project accountability and encourages irresponsible development. We need NEPA to ensure businesses and consumers are informed and have a say in projects that impact their communities and their livelihoods. The administration need look no further than BP Deepwater Horizon disaster to understand the consequences of exempting projects from such oversight. BP was categorically excluded from NEPA review. As a result, the impact of a blowout was never considered or mitigated.  The result of that single fast-tracked project was tens of billions of dollars in economic loss to fisheries, coastal businesses and real estate and environmental ruin. We need effective NEPA because major projects can cause major economic and environmental harm.
  • Increases risks to our waters, public lands and wildlife. That in turn threatens our nation’s $887 billion outdoor industry and its 7.6 million employees. It also will lead to new threats to businesses that rely on clean water, such as the $76.2 billion craft brewing industry. We need NEPA to protect important parts of our economy such as these.
  • Creates controversy, uncertainty and delay for businesses seeking approval. That in turn makes it harder for businesses to plan and increases compliance costs.  The proposed rule overturns 50 years of precedence while triggering a rewrite of all NEPA agency guidelines and will impede new projects for years as stakeholders are forced to navigate a new and uncertain terrain. NEPA efficiency is not improved by a complete upending of the NEPA process.
These provisions not only increase risks but they fail to address the key drivers of project delay including the capacity crisis within the government for conducting NEPA. Rather than undermining economic and environmental protections, the administration should tackle the lack of agency personnel, training, and other resources needed for effective and efficient NEPA review.

Finally, the proposed changes are sweeping in nature and implicate every major federal decision across every federal agency. And yet, CEQ has provided little assessment of the implications of the proposal, allowed only a short comment period and a total of two public hearings across the entire US. Such a huge shift in regulations requires greater opportunity for the public to engage and more consideration by the government. Under the CEQ’s own regulations, changes like this are subject to environmental and economic review that the council has not undertaken.  

For all of these reasons and for the benefit of the economy and the environment we urge you to withdraw this proposed rule.
